Due today were filings to participate as amicus curiae on one of three court cases seeking judicial review of the Environmental Protection Agency’s CAFE standards.
Policy Integrity filed for leave to submit amicus briefs in the three petitions that may be heard before the D.C. Circuit. Each of the petitions aim to attack the EPA’s tailpipe emission standards finalized in the spring.
Though the plaintiffs in the cases have not yet had to submit their substantive arguments for requesting judicial review, all three represent industries that would not benefit from tighter tailpipe standards and it is likely that their cases will be based on a claim of increased economic hardship.
Our amicus would argue that the final rule is supported by the administrative record and by administrative law.
