The Environmental Protection Agency is reconsidering its withdrawal of a waiver of preemption for California’s zero emission vehicle mandate and greenhouse gas emission standards. We submitted comments supporting the rescission of the waiver withdrawal, and previously filed an amicus brief in the D.C. Circuit arguing that applicable limits on EPA’s implicit revocation authority render the waiver withdrawal unlawful.
