Letter to the OMB re: midnight regulations

Agencies are infamous for pushing through regulations on the eve of an Administration’s exit. In May 2008, the Bush Administration issued a bulletin mandating that no regulations were to be proposed after June 1, 2008, except in extraordinary circumstances.

Policy Integrity submitted a letter to the Office of Management and Budget (OMB) alerting it to at least three regulations that violated this deadline, and urging OMB to enforce that deadline. The letter asks OMB to either require agencies to explain why these proposals constitute extraordinary circumstances, or, if they cannot, prevent these agencies from promulgating the rules.
